Terms of Service

1. ACCEPTANCE OF TERMS

The placement of an order implies full acceptance of the terms of service as stated hereon and implied.

To make a purchase from our online shop you must be 18 years of age or over.

If you are purchasing on behalf of another entity such as a company you warrant you have the authorisation to agree to these terms and conditions on behalf of the entity.

 

2.  PRICE, CURRENCY & GST

All prices on this website are stated in New Zealand Dollars (NZD). Orders will be processed in New Zealand Dollars (NZD) only. Loftmotif reserves the right to change prices of goods advertised on this website, without notice. Orders will not be dispatched until payment is received in full.

All prices listed on the Loftmotif website are including GST unless otherwise specified.

 

3.  PAYMENT & SECURITY

We accept direct credit payments from New Zealand bank accounts, major credit cards and cash payments on pickup or delivery. Credit card payments can only be accepted through the website and cannot be used by phone.

 

4. DOMESTIC SHIPPING

All goods are currently sent by Aramex (www.aramex.co.nz) unless otherwise stated for larger items

WITHIN NEW ZEALAND – PLEASE NOTE WE ARE UNABLE TO SHIP TO PO BOXES. PLEASE PROVIDE A PHYSICAL ADDRESS FOR COURIER DELIVERY.

We will provide a tracking number for all orders once the goods have been sent.

Approx Delivery Time: 1 – 4 working days   

Goods sent to rural addresses can take an additional 1-2 working days to be delivered. Customers must inform Loftmotif if their address is rural delivery to avoid additional shipping costs incurred. 

Shipping costs:

For most items, we offer flat-rate shipping per order.

Small items (light bulbs, cable and chain): $7.00

Nationwide urban shipping for items: $12.00

Nationwide rural delivery for items: $18.00

If for any reason the cost of delivery differs from what is quoted we will advise you accordingly. We do not make money from shipping costs and we are happy to arrange a convenient pick-up time if that is preferred.

We use Aramex for all our deliveries, this is a SIGNATURE REQUIRED service. We will process your order as soon as possible within standard business hours. Please note that the stated delivery time is estimated for within business hours, and does not include any time for processing your order. We will email you a confirmation once your order has been shipped, including a tracking number.

When checking out please supply us with a physical address, such as a workplace where there will be someone present to sign for your item between the delivery hours of 9 am – 5 pm weekdays. Aramex DO NOT deliver to PO Box addresses. 

An invoice will be emailed to you at the email address you supply when you place your order. You are responsible for ensuring that your contact details are correct.

 

5. INTERNATIONAL SHIPPING

If you live outside of New Zealand and wish to have a product shipped to you, please email us with your destination and we will provide you with a shipping cost, if possible.

 

6. REFUND POLICY

We hope you love the products you buy from us at Loftmotif. If, for any reason, you are not satisfied with your purchase, please return it to us within 30 days of receipt of the products, provided that the products are in original condition, unused, unwashed and are accompanied by their original packaging. We will replace it or refund the purchase price using the method you used for the initial purchase. Please email katrin@lofmotif.co.nz notifying us that you wish to return an item including the invoice number on the email, and the reason for returning it.

Sale items are NOT refundable.

We cannot accept unused goods in damaged packaging unless they are faulty. Freight charges are not refundable unless the goods are faulty, in which case we will also refund the cost of returning the goods to us.

Products must be returned to the following address, at your own cost, unless the goods are faulty:

Once we have received the returned products we will notify you by email of your exchange or refund entitlement.

 

7. ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if the information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

 

8.  MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the product (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the product.

 

9.  LIMITATION OF LIABILITY

Where you acquire or hold yourself out as acquiring goods or services from us for the purposes of a business, the provisions of the Consumer Guarantees Act 1993 will not apply. The conditions, warranties and guarantees set out in the Sale of Goods Act 1908 or otherwise implied by statute or common law will not apply and are excluded from these terms of trade.

We will always endeavour to have complete and accurate information on our website but to the greatest extent permissible by law we assume no responsibility for the completeness and current accuracy of the information provided on our website.

To the greatest extent permissible by law, we exclude all liability we may have to you for any claim except where we have acted in bad faith. This exclusion also applies for the benefit of every officer, employee, contractor, agent of ours and anyone else we use to perform our duties or provide services under any agreement you have with us. None of the persons specified above is liable or has to pay you for anything else in connection with or resulting from anything any of us does or does not do, or delays in doing, whether or not it is contemplated or authorised by any agreement you have with us. This exclusion applies to whatever you are claiming for and in whatever way liability might arise. This exclusion does not limit any inalienable rights you may have under the Consumer Guarantees Act 1993.

Our maximum liability to you (if any) shall be limited to the value of any faulty products or services supplied by us and we, our employees, contractors and agents, will not be liable to you for loss or damage of any kind however that loss or damage is caused or arises. We recommend that all products, where required, are installed by a Registered Electrician.  Once purchased it is your responsibility to ensure the safe installation of your product.

 

10. PROMOTIONAL TERMS

From time to time Loftmotif may run promotions on this site.

Promotional codes can not be used in conjunction with each other. Only 1 promotional code can be used per transaction.

Promotional codes have a limited availability use and Loftmotif reserves the right to stop any code at any time.

Misuse of any promotional code can result in your order being cancelled and the transaction being credited. Loftmotif reserves the right to cancel any transaction if we feel the code has been misused.

 

11. APPLICABLE LAW AND JURISDICTION

Unless we otherwise agree in writing, this agreement contains all the terms of our relationship and continues to apply no matter where you are located at the time any goods or services are provided to you by us irrespective of the location where you reside.

Use of our website, supply of products or services by us to you and any other matter arising from these Terms and Conditions are subject to the laws of New Zealand. The Courts of New Zealand shall have non-exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with these terms of trade, or with the use of the website or supply of any services.

Where you or any other person whom you act for, or who you permit to act for you supplies incorrect information for the purchase of a product or service and we incur cost in any matter concerning that name then we may recover the costs incurred by us from you (including legal costs on a solicitor-client basis).

You agree to use our website, products and services in accordance with the applicable laws of the country or countries where your business or organisation is based.

You can review the most current version of the Terms of Service at any time on this page.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

At Loftmotif we value our customers and respect their privacy. Any information we collect about you is held with the utmost care and security. We want to make your shopping experience as safe and satisfying as possible. While we may securely store your customer details, we do not sell, trade or share this information with anyone.
